Communication Retention Policy

BlackSpace is a marketplace where you can purchase directly from Seller Members in the United States, and we want you to have a positive experience shopping here. Please read on to find out more about your rights, as well as what is expected of you, as a buyer.

The Network Clause: BlackSpace is a brand of BlackSpace LLC. All commerce on this platform is conducted within the BlackSpace Network, a private, mission-aligned, and expressive association of Seller Members. The Network operates as a private forum for the collective exercise of the First Amendment rights of its members and the platform. All policies herein are subordinated to the Network’s Statement of Curatorial Intent and the LLC’s right to control its expressive message.

This policy is a part of our Terms of Use. By shopping on BlackSpace, you’re agreeing to this policy and our Terms of Use.

1. Overview This policy explains how long BlackSpace keeps the communications that take place through the Services, and why. It covers Account Messages between buyers and Seller Members, content posted in our community forum, and your correspondence with BlackSpace Support.

This policy works alongside our Privacy Policy, which governs how BlackSpace handles your personal information generally. Where this policy and the Privacy Policy address the same subject, the Privacy Policy controls.

This policy is part of the BlackSpace Terms of Use. By using the Services, you agree to it. Disputes between you and BlackSpace are governed by the binding individual arbitration agreement and class-action waiver in Section 11 of the Terms of Use.

2. Why BlackSpace Keeps Communications BlackSpace retains communications to operate and provide the Services, and in particular to:

  • Resolve order issues, including reviewing the messages between a buyer and a Seller Member under our Buyer Resolution Policy.
  • Conduct membership eligibility audits under the Verify-on-Demand process in the Seller Member Policy.
  • Keep the platform safe — to investigate and prevent fraud, abuse, harassment, and policy violations.
  • Meet legal and regulatory obligations, respond to lawful requests, and establish, exercise, or defend legal claims.

This is also why order-related communication must stay on the platform, through Account Messages. Communication taken off the platform cannot be reviewed by BlackSpace and is not eligible for our review.

3. What This Covers

  • Account Messages. Messages exchanged between buyers and Seller Members through the BlackSpace Messages feature.
  • Support correspondence. Your communications with BlackSpace Support, whether by chat, email, or Account Messages.
  • Community content. Posts and other content you share in our community forum and other community spaces.

Marketing and service communications that BlackSpace sends to you — and your choices about receiving them — are addressed in the Privacy Policy, not here.

4. How Long BlackSpace Keeps Them As a general rule, and consistent with the Privacy Policy, BlackSpace keeps communications for as long as your account is active and as long as needed for the purposes in Section 2. BlackSpace keeps them longer where doing so is necessary to resolve a dispute, complete an audit, keep the platform safe, or meet a legal obligation.

  • Account Messages. Kept for the life of your account, and after your account closes, for as long as needed to resolve disputes, complete audits, keep the platform safe, and meet legal obligations.
  • Support correspondence. Kept for the life of your account and as long as needed for the purposes in Section 2.
  • Community content. Kept while it is posted. If you close your account, your community profile is closed and related personal information is deleted, but your posts may remain visible with your name no longer displayed alongside them, consistent with the Privacy Policy.

5. Closing Your Account and Deletion Requests If you close your BlackSpace account, your public posting profile is closed and the personal information connected to it is deleted. Community posts may remain after closure, with your name no longer shown. Account Messages and support records may be retained after your account closes for as long as needed to resolve disputes, complete audits, keep the platform safe, and meet legal obligations.

You may request deletion of your personal information. BlackSpace honors these requests except where it is required to keep information by law or regulation, or to protect the safety, security, and integrity of the platform.

6. Legal Holds Where a dispute, audit, investigation, or legal process is active or reasonably anticipated, BlackSpace preserves the communications relevant to it until the matter is resolved, even if that is longer than the periods described above.

7. Changes to This Policy BlackSpace may update this policy. The version posted at the time applies. Material changes will be reflected on this page.
