Buyer Resolution

This policy was published on June 15, 2026 and it will take effect on June 15, 2026.

BlackSpace is a marketplace where you can purchase directly from Seller Members in the United States, and we want you to have a positive experience shopping here. Please read on to find out more about your rights, as well as what is expected of you, as a buyer.

The Network Clause: BlackSpace is a brand of BlackSpace LLC. All commerce on this platform is conducted within the BlackSpace Network, a private, mission-aligned, and expressive association of Seller Members. The Network operates as a private forum for the collective exercise of the First Amendment rights of its members and the platform. All policies herein are subordinated to the Network’s Statement of Curatorial Intent and the LLC’s right to control its expressive message.

This policy is a part of our Terms of Use. By shopping on BlackSpace, you’re agreeing to this policy and our Terms of Use.

1. Understanding BlackSpace’s Limitations as a Marketplace Except where expressly stated otherwise, BlackSpace is not a party to transactions between buyers and Seller Members and does not take title to, possess, manufacture, store, inspect, or control the items offered by Seller Members. Any assistance provided by BlackSpace through Buyer Resolution is offered at our sole discretion and does not create a fiduciary duty or legal obligation for BlackSpace LLC to resolve disputes to a buyer’s satisfaction. By shopping on BlackSpace, you understand that:

  1. Unless explicitly identified as being sold by BlackSpace, all products and services available on the platform are offered and sold directly by independent Seller Members, and your purchase forms a contract solely between you and the applicable Seller Member;
  2. BlackSpace may, in limited circumstances, offer branded merchandise, digital or physical gift cards, or other designated products directly. In those specific instances only, BlackSpace is the seller of record and is responsible solely for those items;
  3. BlackSpace does not pre-screen items sold on BlackSpace and therefore does not guarantee or endorse any items sold on BlackSpace or any content posted by Seller Members (such as photographs or language used in listings or store policies). Because the Network is an expressive association, the inclusion of any item or content on the platform is an exercise of editorial judgment and does not constitute an endorsement or warranty of the item’s safety, legality, or quality;
  4. Each Seller Member independently establishes their own pricing, processing times, shipping methods, return policies, and other store policies, and BlackSpace is not responsible for a Seller Member’s failure to fulfill an order or comply with their stated policies; and
  5. You assume responsibility if you provide your own materials for a custom order.

To the fullest extent permitted by law, BlackSpace disclaims liability arising from or related to transactions between buyers and Seller Members, including but not limited to claims relating to product defects, shipping delays, misrepresentations, or failure to deliver.

As a member of the community, you have the opportunity to confidentially flag an item or a store that violates any of BlackSpace’s policies.

2. The Payout Hold, and When to Reach Us When you pay for an order, the Seller Member is not paid right away. BlackSpace holds the Seller Member’s share of the sale for a set period:

  • Instant-download digital orders: 72 hours from the time of your purchase.
  • All other orders, including physical orders: 21 days from the date you placed your order.

An order is treated as instant-download digital only when every item in it is set up as a digital download — a downloadable, non-shipped item with a digital file attached. An order that includes any item that ships, or any item not set up that way, receives the 21-day window.

During that period the money stays under BlackSpace’s control and has not been sent to the Seller Member. If your order has not arrived, contact BlackSpace through our Contact page during the hold period. Because the Seller Member has not yet been paid, BlackSpace can refund you from the funds it still holds. Once the hold period passes, the Seller Member is paid and a refund from held funds is no longer available (see Section 6).

In a cart with items from more than one Seller Member, each Seller Member’s share is held on its own clock based on that Seller Member’s items, and is handled separately.

3. What Is Covered Buyer Resolution currently covers non-delivery: you paid for an order and did not receive it within the hold period.

  • Physical goods. None of the items in a Seller Member’s portion of your order arrived.
  • Instant-download digital goods. You did not receive access to the item — the download was unavailable or inaccessible. Once a digital item has been successfully accessed or downloaded, it is considered delivered.

Coverage may expand over time. Any future categories will be described here before they apply.

4. What Is Not Covered Buyer Resolution does not apply to:

  • Items that arrived but are damaged, incorrect, or not as described. For these, see the Seller Member’s return policy in their Store Policies; options may also be available through your payment provider. They are outside this policy for now.
  • A change of mind, buyer’s remorse, or an order you no longer want.
  • Any portion of an order you received. In a cart with items from more than one Seller Member, each Seller Member’s portion is treated on its own, and a portion you received is not refundable under this policy.
  • Local pickup orders. A local pickup order is a physical, in-person handoff with no carrier and no shipment record, so pickup orders are excluded.
  • An order raised after its hold period has passed (see Section 6).

5. How BlackSpace Reviews a Non-Delivery Concern When you let BlackSpace know during the hold period that your order has not arrived, BlackSpace reviews the order record, any tracking the Seller Member entered, and the messages between you and the Seller Member, and decides how to resolve it.

Fulfillment on BlackSpace works on an honor system. BlackSpace does not independently confirm that an item shipped or arrived. In a review, tracking that a Seller Member entered showing delivery to your address is the Seller Member’s record of fulfillment, and an order with no such record weighs in the buyer’s favor.

6. Refunds, and What Happens After the Hold When a non-delivery concern is resolved in your favor:

  • The refund is issued to your original payment method.
  • It covers the product price, shipping, and tax for the affected portion of the order.
  • When BlackSpace refunds you this way, the Seller Member is not paid for that order.

Once the hold period has passed, the Seller Member has been paid and BlackSpace no longer holds the funds, so a refund under this policy is no longer available. If you paid by card, you may still have separate dispute rights with your card issuer; those rights belong to you and your issuer, are independent of this policy, and are outside BlackSpace’s control.

7. Fair Use of This Process Buyer Resolution exists so that buyers are not left without recourse when an order does not arrive. BlackSpace may limit, pause, or decline a refund where the record shows a pattern that suggests the process is being misused.

8. Changes to This Policy BlackSpace may update this policy. The version posted at the time you place an order is the version that applies to that order. Material changes will be reflected on this page.
