Anti-Discrimination & Hate Speech

The BlackSpace Network is a private, mission-driven association that prioritizes the advancement of Black entrepreneurs. This policy governs conduct between members but does not supersede the Network’s right to curate its Seller Membership levels according to its Statement of Curatorial Intent. We want everyone on BlackSpace to feel safe, and our priority is fostering an inclusive environment. This policy explains the kind of behavior we prohibit on BlackSpace to make sure we all have a positive experience.

The Network Clause: BlackSpace is a brand of BlackSpace LLCAll commerce on this platform is conducted within the BlackSpace Network, a private, mission-aligned, and expressive association of Seller Members. The Network operates as a private forum for the collective exercise of the First Amendment rights of its members and the platform. All policies herein are subordinated to the Network’s Statement of Curatorial Intent and the LLC’s right to control its expressive message.

This policy is a part of our Terms of Use. By using BlackSpace, you’re agreeing to this policy and our Terms of Use.

BlackSpace prohibits the use of our Services to discriminate against people based on the following personal attributes (collectively, “protected groups”): 

  • Race
  • Color
  • Ethnicity
  • National origin
  • Religion
  • Gender
  • Gender identity
  • Sexual orientation
  • Disability
  • Any other characteristic protected under applicable law

This list of protected groups governs conduct between members in the marketplace. It does not limit BlackSpace LLC’s First Amendment right to curate the Network as an expressive association dedicated to the advancement of the African Diaspora.

It is your responsibility to know your local laws and any other legal regulations on discrimination that might apply to you. Additionally, BlackSpace does not allow hate speech. Hate speech occurs when violent, offensive, derogatory or demeaning language is directed at a person or group based on their one or more protected group attributes.

Whether you’re engaging with public features on BlackSpace, such as listing items or having direct communication with other members, discrimination and hate speech are not allowed. As a Seller Member on BlackSpace, your store content, including store announcements and store policies, cannot display discriminatory behavior toward protected groups. Examples of prohibited behavior include, but are not limited to:

  • Refusal of service based on membership in one or more protected group. This prohibition applies to individual commercial transactions and does not restrict the Network’s right to decline or terminate membership based on Mission Alignment.
  • Expressing intolerance or a lack of respect for another member on the basis of protected group attributes
  • Having a store policy that excludes sales to members of one or more protected groups listed above
  • Directly or indirectly making derogatory or demeaning remarks against protected groups listed above 
  • Racial slurs
  • Posts that support or glorify hate groups and their members

If you think discrimination or hate speech has occurred on BlackSpace, please report it by contacting BlackSpace and we will investigate. If you see a listing on BlackSpace which you believe violates our Terms, we encourage you to flag the item by using the Report this item link at the bottom of each listing page. We have a timely review process for all reports.
